Terms of Service
These terms govern your use of the Emberly website, waitlist, and app. Emberly is a pre-release product, so these terms are short and will grow up alongside it. By using the site or the app, you agree to them.
The short version: be a good citizen, don't abuse the service, your focus data is yours, and (since this is a beta) the service comes as-is and may change or break while we build it.
Who we are

The waitlist
Joining the waitlist gives us permission to email you about early access and launch updates. It doesn't guarantee access to the app, and you can leave at any time by emailing us. See the Privacy Policy for how we handle your email.
Your account
- You sign in with an Apple, Google, or Facebook account you own. You're responsible for keeping that account secure.
- You must be at least 13 years old to use Emberly.
- One person per account. Don't share accounts or impersonate others.
- You can delete your account at any time; your data goes with it (see the Privacy Policy).
Your content
Your focus sessions, tasks, bio, and everything else you put into the app belong to you. You give us the limited license we need to store it and show it to the people your visibility settings allow: followers, groups, or just yourself. We don't claim ownership and we don't use your content for anything beyond running the service.
Acceptable use
When using Emberly, don't:
- Harass, abuse, or spam other users, including through handles, bios, task titles, or study events.
- Post content that's illegal, hateful, or infringes someone else's rights.
- Attempt to break, probe, or overload the service, or access other users' data.
- Automate, scrape, or resell the service without our written permission.
- Fake focus sessions to game streaks, leaderboards, or your followers' trust. (We can't stop you lying to yourself, but it defeats the point.)
We may suspend or remove accounts that break these rules.
Beta status
Emberly is in active development. Features may change, be removed, or occasionally break; data may be reset during the pre-release period (we'll try to warn you first). The service is provided "as is" and "as available", without warranties of any kind, to the maximum extent permitted by law.
Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the service, including lost data, lost streaks, or missed focus time. Our total liability for any claim is limited to the amount you've paid us to use the service (which, while it's free, is nothing).
Termination
You can stop using the service and delete your account at any time. We may suspend or terminate accounts that violate these terms, or shut down the pre-release service itself. If we do, we'll give reasonable notice where we can.
Changes to these terms
As the product matures we'll update these terms, and the effective date above will change with them. If a change meaningfully affects your rights, we'll flag it (by email or in the app) before it takes effect.
